North Dakota State AED Laws

Consideration of recommendations from a licensed physician is required in establishing training, notification, and maintenance requirements. Every individual expected to use the AED must receive training in CPR and AED use, following American Heart Association or American Red Cross guidelines. There is currently no legislation regarding EMS notification, but the AED must be maintained and tested according to the manufacturer's guidelines. In case of use, contact an appropriate healthcare or EMS provider as soon as possible.

Summary of Requirements
	Physician	Must consider recommendations of a licensed physician in establishing the training, notification, and maintenance requirements of this subsection.
	CPR/AED Training	Every individual expected to use the automated external defibrillator must receive American heart association or American red cross training in cardiopulmonary resuscitation and automated external defibrillator use or an equivalent nationally recognized course in cardiopulmonary resuscitation and automated external defibrillator use.
	EMS Notification	No Current Legislation
	Maintenance Program	Must maintain and test the automated external defibrillator according to the manufacturer's operational guidelines.
	Notification of Use	Any person who provides emergency care or treatment to an individual in cardiac arrest by using the automated external defibrillator shall contact as soon as possible an appropriate health care provider or emergency medical services provider.

ND CC § 32-03.1-02.3 - 2005 Provides Good Samaritan protection for use of an AED and establishes guidelines for AED programs.
